Judge Counselor of the Administrative Court may have violated rule on suspicions

The Administrative Court (TA) through judgment no. 89/2012, of 8 May 2012 issued a decision based on the matter contained in the records of Case no. 214/2010 – 1st Session, referring to the case of the minor Elias Rute Muianga, deceased during the demonstrations of 1 and 2 September 2010 in the cities of Maputo and Matola. The panel of judges that handed down the decision was composed of three magistrates, namely: José Ibraimo Abudo – Rapporteur, José Maria Pereira Cardoso and Paulo Daniel Comoane.

However, some issues contained in these records need to be made public to raise awareness on the one hand and to raise the debate around them on the other, in order to provide transparency in the performance of public institutions and bodies and concomitantly of their respective holders. What is intended is not to discuss the merits of the case – decision, but the intervention of Judge Paulo Daniel Comoane in the aforementioned records and related issues.
