More than two years after the Nyusi Government took office (2015-2020), corruption continues to cause great damage to the Mozambican state and to be one of the main causes that lead to the waste of public funds and, consequently, to delay the economic and social development of the country. However, there are no known strategic and effective actions by the Government produced and implemented with the purpose of combating the lack of transparency and corruption in public bodies and institutions.
The impunity of public officials involved in acts of corruption has been the rule, further substantiated by a weak recovery capacity for funds illicitly diverted from State coffers.
Allied to these facts, legal and legal measures are not being implemented with a view to recovering the assets illicitly diverted from the State's coffers. As an illustration, the Code of Criminal Procedure under review alludes to the figure of Preventive Arrest, whose purpose is the recovery of assets in corruption or other processes. However, the delay in approving the legal instrument in question prevents the effective application of this measure.
