2018 Attorney General's Report Demonstrates Continued Ineffectiveness, Ineffectiveness of the Public Prosecutor's Office

For the first time after the approval of the new Law on the Public Prosecution Service, that is, Law No. 4/2017, of 18 January, applicable since that year and therefore not covered by the 2017 report, the Attorney General presented his Report to the Assembly of the Republic based on constitutional and

in the aforementioned law, which clarifies in what matters the Report must be limited. In particular, the Report “… addresses the general stage of legality control…”, as provided for in paragraph 2 of Article 17.

In this perspective, the only advance verified was in the sense of referring to the matters on which the Report must be presented, but in substantial terms nothing new was added. The indiscriminate concept of the secrecy of justice is always maintained, without marking it out, which makes the report of little relevance in terms of information that actually demonstrates the concrete actions or lack of action of the Public Prosecutor's Office, pursuant to paragraph d) of Article 17 of the same legal instrument prescribes: the Report must contain “Relevant aspects of the functions of the Public Prosecution Service within the scope of the administration of justice, safeguarding the secrecy of justice”.
